Coimbatore: The Consumer Court has ordered Indian Overseas Bank, Singanallur branch here to pay compensation to of Rs. 50,000 to a customer for committing a mistake during cheque clearance.

K.Angulakshmi, W/o K.Kesavaraj resides at Noyyal colony near Ondipudur. Her son who died on September, 21, 2013 allegedly had a financial transaction issue with Mr. Veeramalai, who after a Police complaint came forward for a settlement. He had issued a cheque for Rs. 6 lakhs dated September 8, 2014. drawn on Vijaya bank, Varadarajapuram Branch, Coimbatore.
As, K.Angulakshmi, mother of the deceased is a joint account holder of the account at IOB, Singanallur branch, she presented the cheque for clearing on the said date. However, Veeramalai had reportedly requested to re-present the cheque during the 1st week of December, 2014. As per his request, K.Angulakshmi presented the cheque on December 5, 2014 which was duly credited, on the next day.
After the amount was credited, she had immediately withdrawn Rs. 40,000. And, thereafter when she went to the ATM on December 12, 2014 to withdraw more money. To her shock, she was unable to do so, as the ATM statement showed “Cash Withdrawal Declined”. Clueless on the transation decline, she also contacted the bank officials and also learnt that a cheque issued by her to a third party was also not honoured, despite her account showed an available balance of Rs.5,61,776.92.
As she did not receive proper response from the bank, she served a legal notice to the Bank Manager of the Indian Overseas Bank on December 22, 2014 which was duly served on December 24. She further filed a case in the Consumer Court against The Branch Manager, Indian Overseas Bank, Singanallur Branch.
After due investigation, President, A.P.Balachandran of the Consumer Court pronounced the order in which the bank was directed to permit the complainant to operate her account and transact. Also, to pay a compensation of Rs.50,000/- (Rupees Fifty thousand only) to the complainant with an interest at the rate of 9% per annum from the date of complaint till realization. Also, pay a sum of Rs.3000/ to the complainant towards the cost of litigation.
