A case was filed against Pricol Management on transfer of labourers
Coimbatore: Left Trade Union Centre (LTCU) has an association functioning at the Pricol Industries.
All democratic eyes in TN went on a one-day strike on April 25, 2017 to show their solidarity with the farmers, in which Pricol workers participated as well.
However, the Pricol Management reacted with a deduction of 8-day the wage for those who took part in the strike backfiring into filing a case in the court of law. The workers also put on a strike demanding a hike in wages after that. Pledging not to take revenge on workers for the strike in the tripartite talks before the Labour Department, the administration transferred 302 people to states including Uttarakhand, Andhra Pradesh, and Maharashtra from December 3, 2018, the management thus making the workers union a minority.
The case was strengthened and was transferred to the Industrial Tribunal as per the Madras High Court guidelines. Both the parties placed their demands were, orders were issued to suspend the transfer order. The administration refused to implement the 10B clause and filed a case in the Madras High Court seeking to stay on the order. The association also filed a case seeking directions to implement the government order.
Justice Murugan of the Industrial Tribunal, Chennai ruled the case stating the transfer of the laborers was unjust and the management has to pay the costs of the case and hire the workers back on August 24. On the workers' side, advocates Bharathi, Suresh and Nivedha appeared under the chairmanship of Communist Party Consultative Committee Chairman Kumaraswamy (High Court advocate).
The Industrial Tribunal's decision has delighted 282 workers who have been without work and income for three years. Five workers in the case have died. The government should take appropriate action to get back the employment of workers who lost their jobs after the court verdict.
