Namakkal Consumer Court Orders INR 4 Lakh Compensation to Car Buyer

Namakkal Consumer Court has directed Aadhi Car Pvt. Ltd. and Maruti Suzuki India Ltd. to pay a total compensation of INR 4 lakh to Shahul Hameed from Vadavalli, Coimbatore, for delaying the delivery of a car.

Coimbatore: In a significant ruling, the Namakkal Consumer Court has ordered a car dealership and a major car manufacturer to pay a total of INR 4 lakh in compensation to a customer for undue delay in car delivery. Shahul Hameed, a 40-year-old resident of Vadavalli, had booked a car worth INR 5 lakh from Aadhi Car Private Limited located in Saravanampatti in May 2022. Despite paying the full amount via a private bank loan, the dealership delayed the delivery of the car, causing Hameed undue distress.

Shahul Hameed lodged complaints at the Saravanampatti Police Station and subsequently approached the Consumer Court seeking justice for the financial loss and mental anguish caused by the delay. The case, originally filed in the Coimbatore Consumer Court, was transferred to Namakkal due to a backlog of cases. Eventually, the dealership delivered the car four months late after receiving the payment, but not without significant inconvenience to Hameed.

The court, responding to the grievances, ruled on May 7 that Aadhi Car Pvt. Ltd. and the headquarters of Maruti Suzuki India Ltd. in New Delhi must each compensate Shahul Hameed to the tune of INR 2 lakh, summing up to a total compensation of INR 4 lakh. The dealers were held accountable for the delay which contradicted the initial agreement of delivering the car within five days of full payment.

Advocates V. Rajasekar and K.S. Eiswarya represented Shahul Hameed in this landmark consumer rights case.
