Monsanto petition hearing on September 20

New Delhi: The Delhi High Court will take up on September 20 a petition filed by biotechnology giant MonsantoBSE -0.79 % against the Competition Commission of India's order that rejected its plea challenging a probe against the company's executives.

People aware of the matter said another plea by Monsanto challenging the CCI's order of investigation into alleged anti-competition activities by the company is listed for September 15.

In the court of Justice Sanjeev Sachdeva on Friday, brief arguments were put forth by Monsanto as well as the counsel for CCI.

Monsanto's contention is that a person can't be proceeded against or investigated until and unless there is conclusive finding by the commission regarding the guilt of the company. The regulator is investigating if Mahyco Monsanto Biotech (MMBL) has abused its dominant position as a supplier of genetically modified cotton seeds in the country.

A third case filed by MMBL before the Delhi High Court urging it to put on hold the Centre's cotton price control order, which mandates a panel to fix the maximum price for Bt cotton seeds apart from the trait value, was not taken up. The next date of hearing is yet to be fixed, the persons cited earlier said.

In these cases, Additional Solicitor General Sanjay Jain is the government's counsel, while Sandeep Sethi is appearing for Monsanto and Vaibhav Gaggar is appearing for the National Seed Association of India.
