Coimbatore: There is a court ruling that no FIR can be filed under Sec 188 of the IPC - Tamil Puligal 

Kovai Ravanan, District Secretary of Tamil Puligal has issued a statement condemning the arrest of the online news portal Simplicity.in Founder D. Andrew Sam Raja Pandian.

In the release, he stated that the journalist and cameraman were kept in custody for over 8 hours without any explanation which is a huge democratic breach. 

Narrating the incident, he had stated that on April 23, Founder D. Andrew Sam Raja Pandian was detained after which the journalist and cameraman were released. 

“The Tamil Puligal highly condemns such unfair treatment of journalists,” he said.

He also stated that apart from the sections under which he was booked and arrested, he added that the reason for his arrest was pointing out to the news article published against the non-participation of Minister SP Velumani in COVID-19 relief fieldwork. 

He highly condemned the arrest of the founder under Sections, 188 (Disobedience to order duly promulgated by public servant), 505(1)(b) (intent to cause, or which is likely to cause, fear or alarm to the public) and Section 3 of The Epidemic Diseases Act 1897.

He pointed out that the Madras High Court has ruled in the case of Jeevanantham v/s Government that no FIR can be filed under Sec 188 of the IPC adding that it had also ruled that it is not a crime under Sec 155 (1)(b) to criticise the Government’s actions. 

He urged the government to immediately take appropriate action to release Andrew Sam, at the earliest.
