The Justice reminded that the Motor Vehicle (Driving) Regulations 2017 has listed ways in which traffic offenders should be stopped by the police on duty or any equivalent authority.
The Kerala HC stressed that police officers and motor vehicle inspectors should not engage in physically stopping the vehicles by jumping into their path, by chasing them or throwing lathis at motorists who do not wear helmets or those who fail to stop by during checking.
The whole idea of enforcing law is not to cause casualties. "The objective is not to catch people by surprise but to educate the people in safety habits", emphasised the Justice.
The physical act of trying to stop offending vehicles has lead to more harm, than necessary. In Mumbai, a biker, the pillion and the policemen were injured in one such incident. The speeding two wheeler rammed into the policeman who jumped in front of the vehicle, suddenly. Luckily, no life was lost, the Justice bench recalled.
"It is high time that equipment like digital camera, traffic surveillance camera, mobile phone cameras over even hand held cameras are used by police officers as well as other officers to detect such offences", urged the Justice bench.
Henceforth from December 1, 2019 helmets for both the rider and pillion rider is mandatory in the State of Kerala.
