Speaking on this issue , K Bharathi, State Secretary, All India Central Council of Trade Unions (AICCTU) stated that the Government Order (G.O) No. 221 and 222 were passed under the Sections 10 (1) and 10 B of the Industrial Disputes Act. “This is the third time after 2007 and 2009 that the Government is passing a GO under section 10 (B) with reference to Pricol. After Independence, only six times such GOs have been passed under sections 10 (1) and 10 (B) in Tamil Nadu, and three times it has been with reference to Pricol," said Bharathi.
Referring to the transfer orders by the Pricol management to 302 employees following the employee strikes in December 2018, Bharathi said, "The management passed orders to sack 294 employees who turned down the transfer order on February 11. The Pricol Union approached the Court seeking a stay on dismissal. The Madras High Court, on March 6, stayed the dismissal orders of the 294 employees and advised the State to issue a GO with reference to this issue. The State government issued the GO on May 3, confirming the same."
Speaking on this, Malarvannan, Chief People Officer Pricol said, "The orders did not mention specifically about reinstatement of the workers. The GO is a normal proceeding following a failure report filed by the District Labour Officer in Coimbatore. The Government has ordered the pending case to the Industrial Tribunal. The company will participate in the Industrial Tribunal proceedings and will face the outcome of the legal process."
