Responding to the PIL, the court has also issued orders to the authorities who are respondents to respond for the issued raised by the petitioner.
The PIL filed by C.M. Bhavani (55), an activist from Kumbakonam in Thanjavur District has claimed that hammering of nails would invariably result in its destruction.
In the petition, Bhavani has claimed that despite the enactment of relevant statues to protect environment and prevent deforestation by both the Centre and the State Governments, the laws have not been able to curb the abuse of trees, which are either being cut or killed by nailing.
“The nails inserted trees get rusted and when water along with rust enters the tree, it becomes foist and the particular branch or the entire tree would be completely dried up and died,” Bhavani has said.
The petitioner also claimed that she had personally witnessed the destruction of a misused Peepal tree in her village Mathur, which dried and died due to hammering of nails. “Human beings are indulging in constant destruction of trees and plants, which is going unnoticed by the authorities or deliberately ignored,” the petitioner had stated.
With misuse of trees on the rise, the petitioner has opined that the importance of trees are being undermined, despite the trees providing clean air, clean water, carbon sequestration and a greener environment.
Activist community have welcomed the petition and have claimed that such bold moves from the common man would help curb the cutting of trees in the future.
“You cannot pass a law to allow hammering nails on trees. This is something that cannot be encouraged at any cost. We have been fighting so long to stop this injustice. It is good that the court has taken up the case,” said K. Syed from Osai, an environmental activist hailing from Coimbatore.
Another activist hailing from Madurai urged that rather than focusing on the nailing on trees, it was also imperative to focus on the cutting of trees in the name of development as grown trees are being chopped off for the expansion of roads.
It may be noted that around 110 trees are being on the Siruvani Main Road between Selvapuram and Perur in Coimbatore to give way for a four-way-lane road.
