Coimbatore Court orders Rs.74.94 lakh compensation for man disabled after accident

The Coimbatore Court ordered New India Assurance to pay Rs.53.72 lakh for loss of revenue, Rs.16.90 lakh for medical expenses, totaling Rs.74.91 lakh as compensation for pain and suffering, with 7.50 percent added interest to a man who was disabled after a road accident.


Coimbatore: K Gopalsamy (52) from S S Kulam area of Coimbatore was riding on his two-wheeler Kottaipalayam-Kovilpalayam on June 12, 2016 when a car on the opposite side of the road collided head-on into his two-wheeler.

M Madankumar (32) of Valparai was driving the car when the accident occurred, leaving K Gopalsamy badly injured.

K Gopalsamy had been working as a researcher in a power plant and drawing a salary of Rs.45,000. The road accident not only caused a loss of income for his family but also left him permanently disabled with no job. Therefore, K Gopalsamy sought compensation of Rs 1.50 crore. He filed a petition in the Special Court for Motor Vehicle Accident Compensation Cases.

Judge K Muniraja who heard the case ruled saying, "The third party insurance for the vehicle that caused the accident has been in effect. Given that the petitioner has a job opportunity until 2030, his argument that salary increase, additional income through promotion and other steps will be available is valid. Further, the Medical Board certified that the extent of the disability suffered by the petitioner was 72 percent. This makes it clear that he is suffering from an inability to work.

He has also been fired for this. Therefore, New India Assurance should pay him Rs.53.72 lakh for loss of revenue, Rs.16.90 lakh for medical expenses and a total of Rs.74.91 lakh as compensation for pain and suffering, along with 7.50 percent added interest."
