The Hong Kong authorities have not yet confirmed to India about any action against fugitive diamond merchant Nirav Modi or even his presence within their jurisdiction.

“Our Mission in Hong Kong has informed us that the Department of Justice of Hong Kong is still examining our request for the Provisional Order of Arrest of Nirav Modi. We are awaiting response from the Hong Kong authorities,” said a Ministry of External Affairs (MEA) spokesperson on Thursday.

India has requested Mr. Nirav Modi’s provisional arrest under the Agreement for the Surrender of Fugitive Offenders with the Hong Kong government. Article 10 of the agreement contains terms for the provisional arrest. The provision is applicable in only urgent cases.
